ORDER

The petitioner apprehends arrest for the alleged offence under Sections 69 and 318 (4) of BNS, 2023 in Crime No.4 of 2026 on the file of the respondent police seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the defactocomplainant developed a love relationship while they were college students.. . Under the pretext of marriage, the petitioner allegedly committed sexual assault on the defacto-complainant, resulting in her pregnancy. Subsequently, the

petitioner refused to marry her and forced her to abort the pregnancy. Hence, a case has been registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submits that anticipatory bail application of the co-accused has already been dismissed. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. Considering the nature of allegations against the petitioner and the fact that the anticipatory bail application of the co-accused has already been dismissed, this Court is of the view that the petitioner is not entitled to anticipatory bail.
