ORDER

This Writ Petition has been filed challenging the issuance of eviction notice by the second respondent.

2.When the matter is taken up for hearing today, the learned Standing Counsel appearing for the second respondent would submit that the possession was already taken over and the building was also demolished, therefore, the prayer sought for in the Writ Petition has become infructuous.

3.The learned counsel for the petitioner would submit that, subsequent to the re-construction of the building, the petitioner may be considered for the provision of allotment of flats.

4.In reply, the learned Standing Counsel appearing for the second respondent would submit that the after the issuance of eviction notice, the petitioner vacated the premises without paying the due amount of Rs.1,40,000/-.

5.Considering the submission made by the learned Standing Counsel appearing for the second respondent, this Court cannot pass any orders as pleaded by the learned counsel for the petitioner.

6.With the above observations, this Writ Petition is dismissed. No costs. Connected miscellaneous petitions are closed.
