This Criminal Original Petition is filed under Section 482 of Cr.P.C praying to direct the respondent police not to harass this petitioner and her minor daughter Malavikka and not to threaten this petitioner and her family.

O R D E R

The petition is filed seeking a direction to the respondent police not to harass the petitioner and her minor daughter Malavikka.

It is seen from the submissions that this is a complaint given by one Mr.Vinoth Kumar, the father of the minor accused Malavikka and husband of the petitioner that on 27.03.2021, Gold jewells worth Rs.2 lakhs were stolen from his house. Therefore, this case came to be registered originally under Section 457 and 380 IPC, now altered into Section 457, 380 r/w. 34 IPC.

The learned counsel for the petitioner submitted that the police under the guise of investigation, repeatedly harassing the petitioner and her minor daughter to come to police station and therefore, she seeks the relief that the respondent police should not harass the petitioner and the minor daughter. https://hcservices.ecourts.gov.in/hcservices/

The learned Additional Public Prosecutor opposed this petition on the ground that the minor daughter Malavikka along with her friends have stolen the jewells and she was apprehended and later released on bail by the Juvenile Justice Board. The learned Additional Public Prosecutor also submitted that this petitioner is not an accused in this case.

Recording this submission that this petitioner is not an accused in this case and the fact that the minor daughter Malavikka is already an accused and she was apprehended and later released on bail by the Juvenile Justice Board, this Court finds that this is not a fit case to order the relief prayed for by the petitioner.

Accordingly, the Criminal Original Petition is dismissed.
