PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to consider the representation of the petitioner dated 30.12.2020 for revoking the order of suspension dated 06.02.2020 made in No. 4426/V2/2020 as per the direction issued by the Principal Secretary to Government, Personnel and Administrative Reforms (N) Department Dated 23.07.2015 in pursuant to the judgement of the Hon'ble Supreme Court of India made in SLP (C) No.31761 of 2013 dated 16.02.2015 (in the case of Ajay Kumar Choudhary -Vs- Union of India and another) within stipulated time.

Mr.C.Kathiravan Government Advocate O R D E R This Writ Petition has been filed for issuance of a Writ of Mandamus directing the respondent to consider the representation of the petitioner dated 30.12.2020 for revoking the order of suspension dated 06.02.2020 made in No. 4426/V2/2020 as per the direction issued by the Principal Secretary to Government, Personnel and Administrative Reforms (N) Department Dated 23.07.2015 in pursuance to the judgement of the Hon'ble Supreme Court of India made in SLP (C) No.31761 of 2013 dated 16.02.2015 (in the case of Ajay Kumar Choudhary -Vs- Union of India and another) within stipulated time. 2.Though this writ petition is filed for issuing a Writ of Mandamus to issue positive directions, learned counsel https://hcservices.ecourts.gov.in/hcservices/

appearing for the petitioner states that the petitioner will be satisfied if a direction is issued to the respondent to consider the representation of the petitioner dated 30.12.2020. 3.Having regard to the limited scope of the prayer that is now sought before this Court by the learned counsel appearing for the petitioner, without expressing any opinion on the merits of the petitioner's representation, this writ petition is disposed of with a direction to the respondent to consider the representation of the petitioner dated 30.12.2020 and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order and the respondent is also directed to consider the eligibility of the petitioner to get subsistence allowance and to pass orders and disburse the amount due in case the petitioner is found eligible for subsistence allowance. No costs. Consequently, connected miscellaneous petition is closed.
