O R D E R

(The case has been heard through video conference) The Petitioners who apprehend arrest at the hands of the Respondent Police, for having allegedly committed the offences punishable under Sections 147, 148, 294(b), 324 and 506(ii) of IPC in Crime No. 983 of 2020, have filed this Criminal Original Petition, under Section 438 of Cr.P.C, seeking anticipatory bail. The case of the prosecution is that the petitioners went to the defacto complainant's village and there was a quarrel between the petitioners and the defacto complainants and the petitioners have assaulted the defacto complainant and the defacto complainant has sustained injuries. Hence, the complaint.

The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

The learned Additional Public Prosecutor appearing for the respondent would submit that the injured is discharged from the hospital. He further submitted that the first petitioner is involved in three previous cases, out of which one is murder case, the second petitioner is involved in two previous cases, third petitioner is involved in two previous cases, fourth petitioner is involved in two previous cases, out of which one is murder case and fifth petitioner is involved in three previous cases, out of which one is murder case. Therefore, he strongly oppose to grant anticipatory bail to the petitioners.

Considering the above facts and circumstances and previous antecedents of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioner.
