Application praying that this Hon'ble Court be pleased to condone the delay of 161 days in filling the application to set aside the preliminary decree dated 23.12.2016 passed in C.S.No 76 of 2009.

This Application coming on this day before this court for hearing the court made the following order:

This application is filed to condone the delay of 161 days in filing the application to set aside the preliminary decree dated 23.12.2016 passed in C.S.No.76 of 2009.

2. However, the learned counsel for the applicant has no grievance about the share allotted. The share allotted is 1/4. The learned counsel for the applicant has stated that the applicant was set ex-parte prior to passing of the preliminary

decree. The preliminary decree can be modified only after the ex-parte order is set aside.

3. Accordingly, this application is dismissed with a liberty to file necessary application to set aside the ex-parte order.
