Respondents PRAYER: This Writ Petition filed under Section 226 of Constitution of India, pleased to issue a Writ of Mandamus directing the 4th respondent to consider the Application No. 2021 / 0105 / 31 / 277180 dated 18.06.2021 and to issue an individual sub division patta within time frame and grant such other relief.

The case of the petitioner is that the family partition deed was executed between him and the other legal heirs of his father on 17.09.2014 and further the schedule mentioned property was originally inherited by his father and after the execution of the above said Family Partition Deed, the petitioner is holding peaceful possession of the schedule property and since the schedule mentioned properties are family inherited property, a joint patta was issued. Hence, the petitioner have given several application to issue an individual sub division patta in favour of him and finally on 18.06.2021. However no effective steps have been taken so far. Aggrieved by the same, the petitioner is before this Court.

The learned counsel appearing for the petitioner submitted that it would suffice if this Court issues direction to the respondents to consider the petitioner's application dated 18.06.2021 and may pass appropriate orders within a stipulated time frame as fixed by this Court. 4.The learned Additional Government Pleader appearing for the official respondents has no objection for said order being passed.

5. In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case directs the respondents to consider the petitioner's application dated 18.06.2021 on merits and in accordance with law and pass appropriate orders, after affording opportunity to the aggrieved persons, if any, within a period of twelve weeks from the date of receipt of a copy of this order. This writ petition is accordingly disposed of. No costs.
