ORDER
The order passed by the second respondent herein / the Branch Manager, Tamil Nadu Small Industries Development Corporation Limited, SIDCO Industrial Estate, Krishnagiri-633001 in RC.No. 139/C/2014 on 10.12.2014, is put under challenge in the present Writ Petition. Consequently, the petitioner has sought for a direction to the second respondent to release the Security Deposit and Earnest Money Deposit of Rs.1,35,000/- to him.
2. Heard the learned counsel appearing on either side.

It is the case of the petitioner that the first respondent issued an allotment order to the petitioner on 20.10.2008 with a direction to enter into an agreement with the second respondent with a condition that the terms and conditions of the allotment order forms part of the agreement. Pursuant to which, the petitioner entered an agreement dated 23.10.2008 with the second respondent in respect of Shed No.6, SIDCO Industrial Estate, Krishnagiri. The petitioner made a representation on 17.09.2009 to the first respondent seeking
outright selling of Shed No.6, for which he received a communication from the first respondent stating that the said shed was allotted to his firm. Furthermore, the petitioner sent a representation dated 22.01.2014 to the first respondent seeking permission for change of line of activity following ban order on the exploitation of ground water, however there was no response. He further made a representation to the respondents stating that the petitioner's firm is handing over the said shed. While so, the order impugned in this Writ Petition dated 10.12.2014 was passed, demanding the petitioner's firm to pay the revised rental sum due with penal rent. Aggrieved by the said demand notice, the petitioner made a representation to the first respondent seeking recall of the order and for repayment of the security deposit. Since there was no response, the present Writ Petition.

The learned counsel for the petitioner submitted that in order to avoid exploitation of ground water, the petitioner wanted to change his line of activity, for which he has sought permission from the respondents, since no response, he has vacated the subject premises. He further submitted that there is no clarity in the impugned order and he has vacated the subject premises in the year 2014 itself and hence, he prayed for appropriate orders.
5. On a bare perusal of the impugned order, it is seen that there is no clarity in the said order regarding the fact that on what basis the demand was
made. In order to give a quietus to the issue, as the petitioner himself has vacated the subject premises in the year 2014, this Court directs the petitioner to pay a sum of Rs.1 Lakh to the respondents in regard to the rental due demand, for which, the learned counsel for the respondents has no objection.

The above Writ Petition is disposed of with a direction to the petitioner to pay sum of Rs.1 Lakh in favour of the respondents in respect of the demand notice dated 10.12.2014, within a period of four weeks from the date of receipt of a copy of this order. On receipt of the said amount, the respondents shall close the file pending as against the petitioner herein. Consequently, connected Miscellaneous Petition is closed.
