The petitioner seeks anticipatory bail in Crime No.27 of 2023 registered by the respondent police for the offences punishable under Sections 406 & 420 of IPC, on a complaint alleging that the petitioner is due and payable to the defacto complainant a sum of more than Rs.1 crore.
2. Let me not enter into a detailed discussion of the facts but, it is stated that an arrangement had been reached between the petitioner and the defacto complainant to return back the amount in three tranches. It is stated that some amount had also been repaid but still there is some balance to be paid.
3. Since it is made clear that there has been borrowal with an intention not to repay and on filing of this petition and insistence by my learned predecessor, the amounts had been repaid, and the offence therefore has been made out, this petition stands dismissed. However, the respondent may defer taking any coercive action till 13.11.2023. If the
amount is not fully repaid and not reported by defacto complainant, then, the respondent may act on the dismissal of this petition.
