ORDER
When the matter is taken up today, the learned counsel appearing for the petitioner fairly submitted that though he sent communication to his client, neither he replied to his letter nor he has turned up. Thereafter, when he enquired about the same with his lower Court counter part, he was informed that the respondent/complainant has received the amount due and payable by the petitioner/accused and the parties have settled the matter among themselves. However, they have neither informed this Court nor the counsel.
2. A perusal of the records would go to show that the matter has been pending from the year 2008 and the notice has not yet been served on the respondent/complainant.
3. Hence, recording the submission made by the learned counsel for the petitioner that the matter has been settled among the parties themselves, no further order is necessary in this Criminal Revision Case. Accordingly, the same is closed. Further it is also made clear that if the petitioner submits any compounding application,
the Court below may suspend the sentence of the petitioner/accused, after verifying the settlement entered into between the parties. as no compounding application has been filed before this Court.
