PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the Respondents to consider and pass appropriate orders on the representation of the petitioner dated 20.12.2023 wherein a request has been made for the payment of bills raised by the petitioner for various work orders issued for installing and changing from conventional to Solar and LED lamps with masts all amounting to a tune of Rs.32,33,832/-.

ORDER

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. This Writ Petition has been filed seeking a direction to the respondent to consider the representation of the petitioner dated 20.12.2023.

3. The facts of the case is that the petitioner has entrusted with the work of providing 100 nos of Solar Street light with pole and also to convert the existing conventional lights to Led street light. The petitioner also completed the work but the payment was not done by the respondent. Due to which the petitioner has given a representation to the respondent on 20.12.2023, but the same was not considered. Hence this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondent to consider the 2/5

petitioner's representation dated 20.12.2023 and pass orders.

5. The learned Special Government Pleader appearing for the respondents submits that they have to get instructions from the executive officer of concerned municipality regarding the payment so far made and further submitted that the petitioner has not yet completed the work.

6. Considering the facts of the case, this Court without expressing any opinion on the merits of the case directs the respondent to consider the representation of the petitioner dated 20.12.2023, if the work has been completed and pass orders within a period of eight weeks from the date of receipt of a copy of this Order. This writ petition is disposed of in the above terms. No costs.
