Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing respondents 1 to 4 to conduct within a time frame to be fixed by this Court, a joint survey and inspection of the public water canal in Survey Nos.275, 279/2 and 280/2 at Eduthavainatham Village, Chinnasalem Taluk, Kallakuruchi District, identify and remove all encroachments and obstructions and retrieve the canal from the local villagers who have encroached upon it and thereupon restore the canal to its original width and alignment and ensure free flow of water up to the check-dam and downstream areas.

ORDER

2. The petitioner prays for a direction to the official respondents to remove the encroachments found in S.No.275, 279/2 and 280/2, at Eduthavainatham Village, Chinnasalem Taluk, Kallakuruchi District.

3. Learned counsel for respondents 1 to 4 would submit that the area has already been identified and action is being taken to remove the encroachments from the waterbody in accordance with law.

4. In view of the aforesaid submission, this petition is disposed of with a direction to respondents 1 to 4 to proceed in accordance with law and take steps to remove the encroachments, as expeditiously as possible.
