Order By consent, this Writ Petition is taken up for final disposal. This Writ Petition is filed for a Mandamus directing the respondents to consider the petitioner's representation dated 14.05.2025 regarding the extension of petitioner tenure as Hereditary Joint Muthawalli of Hazrath Syed Edullasha Shuttari Dargha Waqf, Chidambaram (also known as Kasitabad Waqf G.S.No.28/SA and Muslim Chawadi Waqf G.S.No.60/SA) and pass appropriate orders within a time frame.
2. The case of the petitioner is that he was appointed as joint Muthawalli / Administrative Muthawalli vide resolution of the 1st respondent dated 28.05.2015 and as per the said order, his tenure was fixed for a period of 3 years, which expired on 27.05.2018 and after the expiry of the said term, the petitioner continued to function as Hereditary Joint Muthawalli in order to ensure that there is no vacuum in the administration of the Waqf. In order to regularize his position and to enable smooth administration of the Waqf, the petitioner submitted a representation dated 14.05.2025 requesting the respondents to extend his tenure as Muthawalli. Since the representation of the petitioner was not considered so far, the petitioner has come up with the present writ petition.
3. Heard the learned counsel for the petitioner and perused the materials.
4. Considering the limited scope of prayer sought for by the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 14.05.2025 and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
5. The Writ Petition stands disposed of with the above directions. No costs.
