THE HONOURABLE MR. JUSTICE R.SUBBIAH Contempt Petition No.683 of 2016 M.Nagaraja ... Petitioner vs.

Rajendran, The Inspector of Police, Economic Offences Wing, Kancheepuram, Kancheepuram District.

... Respondent Contempt petition has been filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondent for wilfully violating the order of this Court dated 26.11.2015 made in Crl.O.P.No.14867 of 2015. For Petitioner : Mr.A.Ilaya Perumal For Respondent : Mr.P.Govindarajan, Addl. Public Prosecutor.

ORDER

The petitioner filed a petition under Section 482 Cr.P.C. in Crl.O.P.No.14867 of 2015 seeking a direction to the third respondent in that petition to transfer the complaint dated 12.6.2015 to the respondent herein, who was the fourth respondent therein, and to further direct the respondent herein to register his complaint dated

12.6.2015. When the matter was taken up for hearing on 26.11.2015, learned Additional Public Prosecutor submitted that the said complaint was already transferred to the file of the respondent herein. In view of the said statement made by the learned Additional Public Prosecutor, this Court directed the respondent herein to expedite the enquiry on the complaint dated 12.6.2015 given by the petitioner and proceed further in accordance with law, as early as possible. Alleging that the said order has not been complied with, the present contempt petition has been filed.

2. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that on the complaint dated 12.6.2015 given by the petitioner, an enquiry was conducted by the respondent herein and during the course of enquiry, the petitioner has given a letter dated 13.10.2015 stating that there is no need for further enquiry in this matter and hence, the said complaint was closed. He has also produced the closure report.

3. Since the order of this Court has been complied with, I am of the opinion, nothing survives in this contempt petition and the contempt petition is closed. However, if the petitioner is aggrieved over the said closure report, he is at liberty to work out his remedy in

a manner known to law, if he is so advised.
