This application has been taken out for striking out the respondent from party array in the main O.P.No. 687 of 2016, which has been filed for grant of succession certificate in respect of the securities held by Late P.S.Samson, who died on 28.02.2010.

2. The petitioners are the wife and children of Late P.S.Samson. The respondent being the mother of the said Samson was impleaded as a party to the proceedings. Pending these proceedings, the respondent namely Mrs.L.Georginamary died on 05.04.2017. The parties being Christians, Mrs.L.Georginamary, the mother of the deceased Samson is not an immediate heir. Hence, this application is allowed, the respondent is allowed to strike out the name of the respondent in the original petition.

3. The learned counsel for the petitioner to carry out the necessary amendments and file amended copy of the original petition by 16.04.2019. Post on 16.04.2019.
