Respondent PRAYER : Criminal Original Petition filed under Section 439(1)(b) r/w. 482 of Code of Criminal Procedure, to modify the bail condition of depositing a sum of Rs.5,000/- before the learned XIII Metropolitan Magistrate, Egmore, Chennai for furnishing surety and permit the petitioner to furnish surety without depositing Rs.5,000/- in the above Crl.M.P.No.3579 of 2015 on 14.07.2015 in Cr.No.2091 of 2015 on the file of the Inspector of Police, D3 Ice House Police Station, the respondent herein.

O R D E R

This petition has been filed to modify the condition imposed by the Chief Metropolitan Magistrate, Egmore, Chennai.

2. While granting bail in Crl.M.P.No.3579/2015, the Chief Metropolitan Magistrate imposed a condition that the petitioner shall deposit a sum of Rs.5,000/- in the XIII Metropolitan Magistrate, Egmore, Chennai. The present petition has been filed to modify the said condition, stating that the petitioner is economically poor and unable to deposit a sum of Rs.5,000/-. Hence, the petitioner is not able to furnish the surety.

3. Considering the submissions, the condition imposed by the Chief Judicial Magistrate, Chennai in Crl.M.P.No.3579 of 2015, dated 14.07.2015 is modified to the following effect that : (i) the petitioner is directed to deposit a sum of Rs.2,500/- instead of Rs.5,000/- within a period of two weeks from the date of receipt of a copy of this order.

(ii)Except this modification, all other conditions imposed by the Chief Judicial Magistrate, Egmore, Chennai remain unaltered. (iii) It is made clear that no further extension will be given.
