ORDER : The Court Made the following order :- Petitioner, who was arrested and remanded to judicial custody on 07.02.2021 for the offence punishable under Sections 381, 411, 413, 414 r/w 120B of I.P.C in Crime No.33 of 2021, seek bail.
2. The case of the prosecution is that the petitioner along with other accused by name Praveen Singh preplanned to loot the jewellery. The accused Praveen Singh executed the plan and stolen 5 kgs of Jewellery, the petitioner herein is the brain behind the crime. Hence, a law enforcing agency registered a case against the petitioner and other accused.
3. The counsel for the petitioner submit that the petitioner submissted that he is not even present in the scene of occurrence and he has not committed any offence as alleged by the prosecution. Hence he prays for grant of bail to the petitioner. 4.The learned Additional Public Prosecutor opposed the bail application by stating that the petitioner colluded with other accused and stolen 5 kgs of Jewellery from the Jewels shop. She further submits that the co-accused is still absconding and the investigation is still pending.

5. Considering the gravity of offence committed by the petitioner and the investigation is still pending, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
