The petitioners who apprehend arrest at the hands of the respondent police for the offence punishable under Section 397 of IPC in Crime No.1197 of 2020, seek anticipatory bail.
The case of the prosecution is that the petitioners along with other accused persons have robbed two wheeler from the defacto complaint at knife point. There are totally six accused, in which, the petitioners are arrayed as accused 4 & 6 and other accused persons have arrested and remanded to judicial custody. In the petition, the learned counsel appearing for the petitioners submitted that the petitioners were falsely implicated in this case without any evidence. Hence, he seeks anticipatory bail to the petitioners.
The learned Additional Public Prosecutor submitted that there are totally six accused persons, they have robbed two wheeler on 04.06.2020, at Ennore and they were arrested and remanded to judicial custody. 2/4
Heard the learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record. Considering the nature of allegations, this Court is not inclined to grant Anticipatory Bail to the petitioners. Hence, this Criminal Original Petition stands dismissed.
