VELMURUGAN CRIMINAL MISCELLANEOUS PETITION No.5305 of 2021 In CRL.RC.No.244 of 2020 RAHEEMA BEGUM [ PETITIONER ] Vs A.RASHEED MOHIDEEN [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to order payment out of the amount of Rs.1,83,750/- (Rupees One lakh Eighty three thousand seven hundred and fifty only) which is deposited in compliance with the order of this Hon'ble court in Crl.MP.No.1767/2020 in Crl.RC.No.244/2020 dated 15.06.2020 lying in the credit of MC NO.448/11 on the file of V Additional Family court at Chennai by way of RTGS Transfer (or) any other modum to the savings account of the Petitioner vide A/C.No.
38860880992, State Bank of India, Washermenpet Branch, Chennai. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.DJ.ADINARAYANAN, Advocate for the petitioner and of M/S.S.N.A.HUSSAINY Advocate on behalf of the Respondent the court made the following order:- This petition has been filed to order payment out of the amount of Rs.1,83,750/- (Rupees One Lakh Eighty Three Thousand Seven Hundred and Fifty Only).
2. The learned counsel for the petitioner would submit that as per the order of this Court dated 15.06.2020 in Crl.M.P.No.1767 of 2020 in Crl.R.C.No.244 of 2020, the respondent/husband has deposited a sum of Rs.1,83,750/- (Rupees One Lakh Eighty Three Thousand Seven Hundred and Fifty Only) to the credit of M.C.No.448 of 2011 on the file of the learned V Additional Family Court, Chennai. He would further submit that due to health issues, the petitioner/wife is not in a position to go for any job and she is not able to maintain herself and her widow daughter along with her two children. Hence, the petitioner seeks permission of this Court to withdraw the said deposited amount, without prejudice to her legal rights https://hcservices.ecourts.gov.in/hcservices/
and also direct the Family Court to transfer the said amount to the petitioner's savings account vide A/c.No.38860880992, State Bank of India, Washermenpet Branch, Chennai.
3.Heard the learned counsel for the petitioner and the learned counsel for the respondent and also perused the materials available on record.
