The present Miscellaneous petition has been filed seeking extension of time to comply with the order of this Court dated 20.06.2023 made in WP.No.4590 of 2020 dated 20.06.2023.

Learned counsel for the petitioner submitted that, this Court, vide order dated 20.06.2023 made in WP.No.4590 of 2020, disposed of the said writ petition with a direction to the petitioner to pay the entire demand amount of Rs.27,23,596/- to the 2nd respondent in six (6) monthly installments. However, due to some financial crisis and loss faced by the petitioner in his business, he was unable to comply with the above said order of this court. He further submitted that, the petitioner had already taken a Demand Draft for payment of the 1st installment and produced the same before this Court. Accordingly, he prayed for appropriate orders.

3. Learned counsel appearing for the respondents submitted that, the time stipulated by this Court for payment of entire demand amount of Rs.27,23,596/- got over as early as 05.12.2023, however, the petitioner has 1/3

come up with this petition seeking extension of time after a lapse of about seven months, which cannot be acceded to.

Satisfied with the reasons stated in the affidavit filed in support of the petition and also considering the fact that the petitioner had already drawn a Demand Draft for payment of the 1st installment of demand amount, this Court considers it appropriate to allow this petition and, accordingly, time is extended by a further period of twelve weeks from the date of receipt of a copy of this order for the petitioner herein to comply with the order of this Court dated 20.06.2023 and the petitioner is directed to pay the entire demand amount of Rs.27,23,596/- to the 2nd respondent by way of six installments within a period of 12 weeks from the date of receipt of a copy of this order and upon receipt of the last installment, the 2nd respondent is directed to close the petitioner's file as no due.
