J U D G M E N T
It is represented by Ms.K.Hemalatha, (Enrollment No.3732/2023) learned counsel that the matter is amicably settled out of the Court and the counsel on record for the appellant has also made an endorsement to that effect in the bundle and prayed for withdrawing the present appeal. 1/4
2. The appellant/complainant filed a private complaint under Section 200 Cr.P.C., against the respondent/accused for the offence punishable under Section 138 of Negotiable Instruments Act, 1881 before the XIII Metropolitan Magistrate, Egmore, Chennai. The learned Metropolitan Magistrate after analysing the oral and documentary evidence on record, acquitted the respondent/accused under Section 255(1) of Cr.P.C. Challenging which, the present criminal appeal is filed.
3. Since the appellant/complainant wants to withdraw the case, as the matter has been amicably settled out of Court, the Criminal Appeal stands dismissed.
