ORDER
This writ petition has been filed by the petitioner seeking to direct the 2nd respondent to issue the passport to the petitioner pursuant to petitioner passport vide number T8829095 issued dated 19.09.2019 and the petitioner representation to the respondent dated 30.01.2025. 2.Learned counsel for the petitioner would submit that the petitioner was placed in job in Laos City, Thailand. Due to significant stress and discomfort in the workplace, he was unable to continue under the job and subsequently resigned and returned to India on 21.02.2024. While so, the petitioner's friends were planning to go to Bangkok for a trip and they approached the petitioner to join in the trip. Therefore, the petitioner was about to travel on 21.04.2024 to Bangkok and during the immigration check, the 1st respondent seized the petitioner's passport on the ground of passport tampering. Therefore, in this regard, the petitioner made a formal representation to the 2nd respondent. However, till date there is no response from the respondents Authorities. Hence,
the present writ petition has been filed.
3.Learned Senior Central Government Standing Counsel appearing for the respondents by referring the counter affidavit would submit that the passport of the petitioner was seized with the remark that the said passport was tampered by removing a Sticker Visa on Page No.22 and the matter has been referred to the Superintendent of Police, Villupuram District for conducting enquiry and the Superintendent of Police, in his report, has stated that though the applicant/petitioner claimed his employer has removed the visa sticker on Page No.22 in his passport, his explanation is not convincing. Furthermore, there was a caution entry against the Passport Number T8829095 made by Embassy of India, Vientiane, Laos stating that the petitioner has been rescued from Golden Triangle SEZ in Lao PDR by Embassy of India, Veintiane, in August 2023.
However, the petitioner again went to Golden Triangle after rescuing. Therefore, he cheated Lao Police and Embassy of India. 4.He would further submit that the matter has already been referred to the Ministry of External Affairs, New Delhi for inclusion of petitioner's name in Prior Approval category since he has been frequently visiting Lao PDR, Thailand and Vietnam "Golden Triangle as part of Cyber Slavery Scam network. Hence, he prayed to dismiss the present writ petition.
5.Heard the learned counsel for the petitioner as well as the learned Senior Central Government Standing Counsel appearing for the respondent. 6.In view of the above, though the learned Senior Central Government Standing Counsel appearing for the respondents has filed the counter and raised strong objection for considering the plea of the petitioner, considering the limited prayer sought for in this writ petition, without going into the merits of the case, this Court directs the 2nd respondent to consider the petitioner's representation dated 30.01.2025 and pass detailed order on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order.
