The petitioner filed this Civil Revision Petition to reject the plaint in O.S.No.1318 of 2015 on the file of I Additional District Munsif, Coimbatore.
2. There is an alternative remedy available to the petitioner by invoking Order VII Rule 11 of the Code of Civil Procedure. There is no question of invoking the supervisory jurisdiction under Article 227 of the Constitution of India, when there is an alternative remedy available to the petitioner. I am therefore of the view that there is no extraordinary circumstances to by pass the statutory remedy. Liberty is granted to the petitioner to approach the Trial Court with an application under Order VII Rule 11 of the Code of Civil Procedure.
3. The Civil Revision Petition is disposed of with liberty. No costs. Consequently, connected miscellaneous petition is closed. 15.11.2016 TK To 1.The I Additional District Munsif, Coimbatore. 2.The District Educational Officer, Coimbatore. 3.The Chief Educational Officer, Coimbatore.
