Respondents Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, pleased to direct the respondent police to complete the enquiry and investigation and issue the Non Traceable Certificate within the stipulated period as prescribed by this Court based on the representations dated 21.09.2023, 24.10.2023 to the 3rd respondent and on 13.12.2023 to the 2nd respondent.

O R D E R

Regarding tracing the lost documents, the Commissioner of Police has already issued a circular formulated guidelines. The petitioner herein without compliance the guidelines had approached this Court for direction to complete the investigation and issue Non Traceable Certificate, such prayer cannot be entertained unless and until they have to prove that they had documents in their possession got lost. 2.

Further, the guidelines issued by the Commissioner of Police to be complied to enable the police to make attempts to trace the lost documents, if at all it is really lost. Giving Non Traceable Certificate is not an empty formality. It is related to the property right and title. Hence this Criminal Original Petition is dismissed. It is open to the petitioner to comply the guidelines of the Commissioner of Police and proceed. 02.04.2024 Index : Yes/No rpl To 2/4
