This application has been filed seeking leave to sue the Respondents, 1 to 5, Page 2 / 4

8 and 10.

2. The main contention of the Applicant is that the suit has been filed for recovery of money. The allegation set out in the application is that there is a fraud committed by the respondents all over India including the jurisdiction of this Court and hence part of cause of action arose within the jurisdiction of this Court. Therefore, the Applicant is entitled to maintain the suit as against the defendants who are not residing within the jurisdiction of this Court.

3. Having regard to the nature of the allegations set out in the application, the alleged fraud has been committed all over India and the defendants are not residing within the jurisdiction of the Court, part of cause of action arose within the jurisdiction of this Court, the leave is granted and the application is ordered. 23.06.2020 ggs Page 3 / 4
