Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents herein to dispose the representation dated 19.03.2015 within the stipulated period prescribed by this Court.

ORDER

Mr.S.Gunasekaran, learned Government Advocate takes notice for the respondents.

2. The petitioner is a Village Administrative Officer. His service is yet to be regularized. In the meantime, he reached the age of superannuation. Unless his service is regularized, he could not get any terminal benefits. He was not permitted to retire and also no benefits were paid in view of non regularization and in view of pendency of the departmental proceedings. The second respondent/District Collector, Tirunelveli District, vide proceedings in A1/40980/2013, dated 28.02.2014, issued a direction https://hcservices.ecourts.gov.in/hcservices/

to the third respondent/Sub-Collector to enquire on the complaint and give a report. Since the enquiry of the third respondent on the complaint given by one Durairaj is still pending, the petitioner is not permitted to retire and the service is also not regularized.

3. In these circumstances, the third respondent is directed to submit a report as per the direction dated 28.02.2014 of the second respondent referred to above, within a period of four weeks from the date of receipt of a copy of this order and the first respondent is directed to pass appropriate orders based on the report of the third respondent, within a period of six weeks thereafter.
