ORDER
By consent of learned counsel on both side, this writ petition has been taken up for final disposal at the admission stage itself.
2. The present writ petition is filed praying for a writ of Mandamus to direct the 1st to 10th respondents to consider the petitioner's representation dated 21.01.2026.

It is submitted by the learned counsel for petitioner that petitioner is a licensed quarry operator engaged in quarrying operations with valid statutory permissions granted by competent authorities. Petitioner Company was granted a quarry lease by the 9th respondent vide proceedings dated Rc.No.634/Mines/2018 dated 13.10.2022 under Rule 19(1) of the Tamil Nadu Minor Mineral Concession Rules, 1959, in respect of the patta lands comprised in S.F.No.60/1B measuring an extent of 0.19.0 hectares, S.F.No.61 measuring an extent of 0.32.0 hectares, totalling an extent of 1.75.5 hectares situated at Sikkarampalayam Village, Mettupalayam Taluk, Coimbatore District, for quarrying rough stone for the lease period from 13.10.2022 to 12.10.2027 and gravel for the lease period from 13.10.2022 to 12.10.2025.

It is stated that 11th respondent is the owner of the Plot comprised in Survey No.57/2, situated in Sikkarampalayam Village, Mettupalayam Taluk, Coimbatore District, which is stated to be located within the prohibited radial distance of 300m from the petitioner's quarrying site and the 11th respondent has commenced construction activities. It is the case of the petitioner that no construction activity is permissible within a distance of 300 m from any quarry,
in terms of Rule 36(1-A)(c) of the Tamil Nadu Minor Mineral /Concession Rules, 1959. It is under such circumstances, the petitioner submitted a representation on 21.01.2026 in this regard. Since there has not been any action, the petitioner has approached this Court by way of this writ petition.

In view thereof, the writ petition stands disposed of with a direction to the respondents to consider the representation of the petitioner dated 21.01.2026 on merits and in accordance with law after giving due notice and after affording a reasonable opportunity of hearing to the petitioner, 11th respondent and other interested parties within a period of four (4) weeks from the date of uploading of web copy of the order without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the respondent to consider the representation on its own merits and in accordance with law.
