PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records of the 3rd Respondent in passing the Impugned order Dt.02/01/2019 in ref No.4137/M1/2018 refusing to admit and register the Petitioners' Settlement Deed Dt.28/08/2018 executed by them in favour of their son Mr.A.Venkatesan and quash the same and direct the 2nd Respondent to admit and register the above Settlement Deed Dt.28/08/2018 and to release the above document after completing the registration formalities to them. O R D E R

Challenging the order passed by the 3rd respondent, the present Writ Petition has been filed seeking quashment of the same and also for a consequential direction to the 2nd respondent to admit and register the settlement deed dated 28.08.2018 and to release the said document after registration.

2. It is the case of the petitioners that they had presented the settlement deed dated 28.08.2018 for registration before the 2nd respondent however, the same was refused registration vide refusal check slip dated 05.12.2018 citing pendency of litigations in A.S.No.59 of 2017 on the file of the Additional District Court, Arani (Fast Track) and A.S.No.34 of 2017 on the file of the District Court which is totally in contravention of the standing order issued by the 1st respondent, 2/4

against which, the petitioners made a complaint before the 3rd respondent, however, the said complaint was rejected vide the present impugned order confirming the refusal of the 2nd respondent. Aggrieved by which, the petitioners have come up with the present Writ Petition.

3. Learned counsel appearing for the petitioners submitted that Second Appeal is pending before this Court in S.A.No.329 of 2023.

4. In view of the above, the petitioner is permitted to approach this Court by filing CMP in pending S.A seeking permission of this Court to present the settlement deed before the District Registrar concerned so as to enable him to pass appropriate orders.

5. Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. 04.09.2025 Index : Yes / No Speaking Order / Non-speaking order Nhs M.DHANDAPANI, J 3/4
