ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Special Judge for trial of cases under SC and ST (PoA) Act, Salem, to

consider the bail application of the petitioner herein in Crime No.58 of 2026 on the file of the second respondent, on the same day of his surrender. 2.

The case of the prosecution is that the petitioner and the de facto complainant are adjacent land owners. Owing to a dispute, the petitioner had entered into the land of the de facto complainant and damaged the fence and shed in the property belonging to the de facto complainant. When it was questioned, the petitioner along with other accused abused the defacto complainant by using his caste name and assaulted him. Hence the case. 3.

Heard the learned counsel on either side and perused the materials on record.

Considering the submission made and on perusal of the materials it is seen that the petitioner and the de facto complainant are adjacent land owners and due to some previous enmity, the petitioner along with other accused trespassed into the property belonging to the de facto complainant, abused him by using his caste name and assaulted him and also caused damaged to his property.

In view of the above factual position, there shall be a direction to the learned Special Judge for trial of cases under SC and ST (PoA) Act, Salem

to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.58 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (POA) Act, 1989. The petitioner shall surrender before the jurisdictional Court within a period of fifteen days from the date of receipt of a copy of this order. 6.
