ORDER

The petitioner has come up with this petition seeking for a direction to change the investigation to some other agency like CBCID or any other agency in respect of Crime No. 173/2015 now pending on the file of first respondent police.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. From a perusal of the materials available on record, it is seen that the petitioner was assaulted on 22.5.2015 and he was an inpatient in Government Hospital, Thiruvallur from 22.5.2015 to 28.5.2015. From 29.5.2015 to 6.6.2015, he was again admitted as an inpatient in Government Dental Hospital, Chennai. The Wound Certificate shows that the petitioner has suffered grievous injuries. Whereas, the concerned Sub Inspector of Police has registered a case for an offence under section 323 IPC on 27.5.205 and let out the accused on bail.

Under such circumstances, the investigation in Crime No.173/2015 is transferred to the file of Inspector of Police, Thiruvalankadu Police Station, who shall conduct investigation under the supervision of the Deputy Superintendent of Police, Thiruthani. https://hcservices.ecourts.gov.in/hcservices/

The first respondent Sub Inspector of Police is directed to immediately hand over the case in Crime No.173/2015 to the Inspector of Police, Thiruvalankadu Police Station, within a period of one week from the date of receipt of a copy of this order.

5. This Criminal Original Petition is disposed of with the above direction.
