ORDER
The present writ petition has been filed for a direction to third respondent to consider petitioner's representation dated 21.02.2024 and direct him to take appropriate steps as prayed in the said representation.
2. Petitioner is a construction firm, registered under the GST Act and was successful bidder for a contract awarded by the Tamil Nadu State Agricultural Marketing Board. He would submit that there was an increase in the GST rate for Works Contract services provided to the respondent department from 12 % to 18% with effect from 18.07.2022. Petitioner had complied with such demand and sough for reimbursement by way of his representation dated 21.02.2024.
3. Learned State Counsel for respondents would submit that the above representation would be considered and appropriate orders would be passed in accordance with law, after affording opportunity of hearing to petitioner, within a time frame to be fixed by this Court.
4. In view thereof, there shall be a direction to third respondent, to consider petitioner's representation dated 21.02.2024 on its own merits and pass appropriate orders, in accordance with law, after affording reasonable opportunity of hearing to petitioner, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case.
5. Accordingly, writ petition stands disposed of. There will be no order as to costs.
