O R D E R

(Order of the Court made by M.DURAISWAMY,J.) The petitioner has filed the above writ petition to issue a Writ of Mandamus, directing the 1st respondent to consider the representation made by the petitioner dated 01.07.2018, to take appropriate action against the erred officers and redress the grievances of the petitioner.

2. It is the case of the petitioner that he gave a representation dated 01.07.2018 to cancel the e-auction sale notice on the ground of default and extend the OTS (One Time Settlement) Scheme and take appropriate action against the erred officers of the respondent-bank.

3. It is settled position that the bank cannot be compelled to agree for One Time Settlement proposal given by the petitioner. If the proposal given by the petitioner is reasonable and acceptable to the respondent-bank, in that case, the respondent-bank can consider accepting the OTS proposal. As a matter of right, the petitioner cannot claim that the OTS proposal given by him should be accepted.

4. In these circumstances a mandamus cannot be issued to the respondent-bank. The writ petition is devoid of merits and the same is dismissed. No costs.
