No. 4406 of 2024 dated 23.02.2024 within a time.

O R D E R

Heard Mr. V.S.Jagadeesan, learned counsel for the petitioner, Mr. P.Venkatesperumal, learned counsel for the first respondent and Mr. C.S.K.Sathish, learned counsel for the second respondent and perused the materials placed on record, apart from the pleadings of the parties.

This writ petition has been filed for a mandamus directing the respondent to pay interest on the belated payment of terminal benefits namely commutation of pension amount, leave surrender salary and CRBS amount to the petitioner at the rate of 6% per annum, for the period from 31.07.2019 that is the date of retirement till date of settlement.

3. When the matter came up for hearing, the learned counsel appearing for the respondents fairly submits that, in these cases, this Court has consistently allowed the payment with interest at the rate of 6% per annum.

4. In that view of the matter, this writ petition is disposed of on the 2/4

following terms:

(i) the respondents are directed to calculate and disburse the interest at the rate of 6% per annum on the belated payment of terminal benefits, viz., commutation of pension amount, surrender salary and CRBS amount at the rate of 6% per annum from the date it became due till the date of disbursement to the petitioner within a period of twelve (12) weeks from the date of receipt of a copy of this order with interest; and (ii) if the amount is not paid within a period of twelve (12) weeks, thereafter, the same shall carry the interest at the rate of 12% per annum from the date it became due till the date of disbursement. No costs.
