This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus directing the first respondent to issue appointment order to the petitioner to the post of Sanitary Assistant with effect form 01.10.2007 onwards and to release salary to the petitioner for the post of Sanitary Assistant /Sanitary helper with effect form 01.10.2007 onwards with interest.

Mr. R.Syed Mustafa Special Government Pleader (Puducherry) Order This writ petition is filed for the following relief: "To direct the first respondent to issue appointment order to the petitioner to the post of Sanitary Assistant with effect form 01.10.2007 onwards and to release salary to the petitioner for the post of Sanitary Assistant /Sanitary helper with effect form 01.10.2007 onwards with interest."
2. The petitioner was appointed as a Sanitary Helper in the 2nd respondent school on 04.04.1994, on a consolidated pay basis. Thereafter, the petitioner was appointed as a Sanitary Assistant with effect from 01.10.2007 vide order dated 30.09.2007. The petitioner's case is that the proposal sent by the 2nd respondent for appointing the petitioner as Sanitary Helper / Sanitary Assistant under the Grant-in-aid scheme was not considered by the 1st respondent. Therefore, the petitioner is before this Court for the aforesaid relief.
3. Considering the facts and circumstances of the case and the fact that the 2nd respondent has been addressing the 1st respondent since the petitioner's appointment, a direction is issued to the 1st respondent to consider the proposal
sent by the 2nd respondent and pass orders on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.
4. With the above direction, this writ petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 09-06-2026 Index: Yes/No Speaking/Non-speaking order KAN
