Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to pass orders on the application submitted by the petitioner seeking alternation of date of birth in the service register as 16.06.1965 instead of 05.03.1964 in accordance with statutory requirements contemplated under Section 59 of the Tamil Nadu Government Servants (Conditions of Service) Act and consequently allow the petitioner to continue in service till the date of reaching the age of superannuation based on the revised date of birth with consequential benefits, within a time frame to be fixed by this Court.

This writ petition has been filed for direction directing the respondents to pass orders on the application submitted by the petitioner seeking alternation of date of birth in the service register. 2.

Today when the matter is taken up for hearing, the learned Senior Counsel appearing for the petitioner seeks permission of this Court to withdraw the petition, since the application submitted by the petitioner

was rejected by the fourth respondent by his proceeding dated 26.03.2024. He also made an endorsement in the Court bundle to that effect.

Considering the submissions and endorsement made by the learned Senior Counsel appearing for the petitioner, the Writ Petition stands dismissed as withdrawn with liberty to challenge the order of rejection. Consequently, connected miscellaneous petition is closed. There shall be no orders as to costs.
