ORDER

The petitioners, who were arrested and remanded to judicial custody on 29.12.2025 for the alleged offences under Sections 331(6) and 305(e) of B.N.S. in Cr. No.495 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant is working as Head Clerk of District Munsif-cum-Judicial Magistrate Court, Madukkarai. On the date of occurrence, all the accused illegally conspired together and went to the place of occurrence i.e., District Munsif-cum-Judicial Magistrate Court, Madukkarai during the night hours, broke open the lock of the Deputy Nazir Room by using iron rod and broke open the box, in which the case properties were kept and committed theft of two cell phones. Hence the case.

The learned counsel for the petitioners would submit that the petitioners are innocent persons, they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He would further submit that based on the confession of A1, these petitioners have been implicated in this case and the petitioners are under incarceration since

29.12.2025 and the petitioners are ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioners.

The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and opposed to enlarge the petitioners on bail by stating that the 1st petitioner has one previous case registered under POCSO Act and if the petitioners are enlarged on bail, they may abscond.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submissions made by the learned Government Advocate, it is seen that there are three accused and these petitioners are A2 and A3. According to the prosecution, these petitioners along with other accused entered into the Court premises on the date of occurrence and vandalised the property and also had stolen the case properties namely two cell phones. From the submissions of the learned Government Advocate, the seriousness of the issue can be visualized. The person who is entering into the Court and removing the case property is serious in nature, which has got cascading effect. In such view of the position, more specifically as the 1st petitioner has one previous case, if

the petitioners are enlarged on bail, there is every possibility of tampering of evidences and may delay the trial proceedings by absconding. Therefore, this Court is not inclined to enlarge the petitioners on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 13-03-2026 MJS Note:
