ORDER

Vide order dated 30.09.2021 passed in Crl.M.P.No.9813 of 2021 in Crl.A.No.445 of 2021, this Court had enlarged the petitioner/appellant on bail, subject to certain conditions. One among such conditions is that the petitioner/accused shall report before the Special Judge/Chief Judicial Magistrate, Kancheepuram District at Chengalpattu, on the first Monday of every English calendar month at 10.30 a.m., until further orders. This Criminal Miscellaneous Petition has been filed by the petitioner/appellant seeking relaxation of the aforesaid condition.

2. At the outset, it is pertinent to point out that the name of the petitioner/appellant in the appeal as well as petition, has been erroneously shown as "R.Padnababhan" instead of the correct name, namely "R.Padmanabhan". A perusal of the entire materials on record also would reveal that the name of the petitioner/appellant is only "R.Padmanabhan" and not "R.Padnababhan," as stated in the appeal as well as in this petition. Hence, the name of the petitioner/appellant is consciously shown in the cause title of this order as "R.Padmanabhan" instead of "R.Padnababhan".

3. The learned counsel appearing for the petitioner/appellant submitted that the petitioner/appellant, being 71 years of age and suffering from hepatic encephalopathy, is unable to appear before the Court concerned and comply with the aforesaid condition and hence, the same may be relaxed.

4. Considering the submission made by the learned counsel for the petitioner/appellant, this Court is inclined to relax the condition imposed at para No.6 (ii) by this Court vide order dated 30.09.2021.

5. Accordingly, the condition regarding the petitioner's appearance, as imposed by this Court at para No.6 (ii) of the order dated 30.09.2021 passed in Crl.M.P.No.9813 of 2021 in Crl.A.No.445 of 2021 stands relaxed. However, it is made clear that the petitioner/appellant shall be duly represented by his counsel before the Trial Court, as and when required. Further, in the event of any change in the petitioner/appellant's address, the counsel shall promptly intimate the same to the Trial Court. The other condition viz. the condition imposed at para 6(i) of the order dated 30.09.2021 shall remain unaltered.
