ORDER
The petitioner, who was arrested and remanded to judicial custody on 11.02.2026 for the alleged offences under Sections 329(4), 296(b), 115(2),
351(3) and 109 of B.N.S. and Section 3 of TNPPDL Act in Cr. No.29 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 10.02.2026, the petitioner along with other accused abused the defacto complainant in filthy language and when the same was questioned by the defacto complainant's mother, the petitioner slapped her. Apart from that, the petitioner attempted to attack the defacto complainant's husband using knife and when the defacto complainant locked the petitioner inside a room, he damaged the household properties. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that there is no injury to anyone and the petitioner is under incarceration since 11.02.2026 and investigation is also over and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Criminal side) appearing for the respondent police opposed to enlarge the petitioner on bail by stating that the petitioner is a history sheeter and he has 18 previous cases and investigation is at preliminary stage.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. From the submissions made by the learned Government Advocate, it is clear that the petitioner has 18 previous cases in his credit and in this case, investigation is at preliminary stage. In such view of the position, it is inexorable to dismiss the petition as the petitioner does not deserve for any bail at this juncture, as he is a history sheeter.
7. Accordingly, this Criminal Original Petition is dismissed. 13-03-2026 MJS Note:
