Vinoth Kumar, Trustee Velliangiri Malai, PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order in Na.Ka.No.129/1435, dated 21.02.2026 and quash the same and consequently, de-seal the petitioner's shop, thereby, permit the petitioner to carry out her business at 10/122, Gandhi ji Street,Muttathuvayal, Ikkaraiboluvampatty,Semmedu, Coimbatore - 641 114. ORDER

The present Writ Petition has been filed seeking the issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order in Na.Ka.No.129/1435, dated 21.02.2026 and to quash the same and consequently, to direct the respondents to de-seal the petitioner's shop and permit her to carry on her business at No. 10/122, Gandhi ji Street, Muttathuvayal, Ikkaraiboluvampatty, Semmedu, Coimbatore - 641 114.

The learned counsel for the petitioner submitted that the petitioner is a self-employed woman, who as been running a business at Arulmigu Vellingiri Andavar Thirukovil for the past 13 years without any hindrance. It is further submitted that the second petitioner conducted an auction on 09.01.2026 in respect of the vendors, in which, the petitioner was a successful bidder and had also remitted the requisite amount towards the said auction. Subsequently, the second respondent issued a termination order against the petitioner alleging that she was selling banned articles in the said shop. Challenging the same, the present Writ Petition has been filed.

The learned counsel appearing for the petitioner further submitted that the petitioner had inadvertently committed the said mistake for the first time and therefore, this Court may issue appropriate directions to the official respondents to collect the fine amount from the petitioner. It is also submitted that the petitioner undertakes not to sell any banned articles in the shop in future. In this regard, the petitioner had already filed an affidavit before the second respondent. It is therefore prayed that the second respondent may be directed to condone the lapse committed by the petitioner and to de-seal the premises.

4. The learned Special Government Pleader appearing for respondent Nos.1 and 2 submitted that if the petitioner makes a payment of Rs.50,000/- as fine, the shop will be de-sealed.

5. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.

6. Considering the facts and circumstances of the case and the submission made by the learned counsel for the petitioner, this Court directs the petitioner not to sell any banned articles in future and further directs the petitioner to pay a fine amount of Rs.50,000/- to the second respondent. Upon such payment, the second

respondent is directed to de-seal the petitioner's shop. In the event of any such violation, it is open to the official respondents to initiate appropriate proceedings against the petitioner in the manner known to law.

7. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
