O R D E R
This Transfer Civil Miscellaneous Petition has been filed seeking transfer of O.P.No.2072 of 2018 on the file of II Additional Family Court, Chennai to the file of Sub Court, Kumbakonam.
2. Respondent and petitioner are husband and wife. The respondent/husband filed a petition for divorce on the ground of cruelty and mental illness of the wife. The petitioner/wife is residing with her grandfather at Kumbakonam. She finds it difficult to travel down to Chennai which is 300 kms away from Kumbakonam. Therefore, she seeks transfer of O.P.No.2072 of 2018 filed by the husband before Family Court, Chennai to Sub Court, Kumbakonam.
3. There is no appearance on behalf of the respondent for the past two hearings.
4. Considering the physical hardship caused to the wife and also allegations of mental condition of the wife, this Court https://hcservices.ecourts.gov.in/hcservices/
considers it fit to transfer the case to the Court which is nearer to her residence.
5. Accordingly, H.M.O.P.No.2072 of 2018 pending on the file of II Additional Family Court, Chennai is withdrawn and transferred to the file of Sub Court, Kumbakonam.
6. The Transfer Civil Miscellaneous Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
