J U D G M E N T

(Judgment of the Court was delivered by K.K.SASIDHARAN,J.) The respondent filed the original proceedings in HMOP.No.185 of 2018 seeking a decree of dissolution of marriage.

2. In the said proceedings, the appellant filed an interlocutory application in I.A.No.4484 of 2018 seeking interim maintenance. The Trial Court by order dated 01.10.2018 directed the respondent to pay a sum of Rs.25,000/- towards litigation expenses and a sum of Rs. 6,000/- per month towards monthly cost of the case proceedings and interim maintenance. The appellant has come up with this Appeal for enhancement.

3. The parties appeared before this Court on an earlier occasion. When it was pointed out as to whether the matter could be settled, they took time for ascertaining the feasibility.

4. When the appeal is taken up for hearing today, the parties have filed a Joint Memorandum of compromise dated 23.09.2019. The memo is taken on record.

5. The parties are present in Court today. The parties have confirmed the factum of settlement and execution of Joint Memorandum of compromise dated 23.09.2019.

6. The respondent has paid a sum of Rs.4,00,000/- to the appellant by way of Cheque bearing No.000121 dated 23.09.2019 drawn on Karur Vysya Bank, Velachery Branch. The parties also agreed to file joint application for dissolution of marriage by mutual consent before the Trial Court.

7. In view of the settlement arrived at among the parties as per the Joint Memorandum of compromise dated 23.09.2019, there is no need for a further adjudication of the issue in the present Appeal.

8. The Civil Miscellaneous Appeal is disposed of in terms of the Joint Memorandum of Compromise.
