ORDER

(Order of the Court was made by S.M.Subramaniam J.) Contempt Petition has been instituted to punish the respondents for their willful disobedience of the order of this Court dated 24.04.2024 made in WP.No.11158 of 2024.

2. The relevant paragraphs of the order dated 24.04.2024 is extracted hereinunder, "....

3. It is made clear that we have not opined about any encroachment or otherwise, it is on the basis of the submissions made by the learned State Government Pleader, the writ petition is disposed of. The aggrieved parties, if any, are entitled to defend in case some action is initiated.

4. The writ petition, accordingly, stands disposed of. There shall be no orders as to costs."

3. With reference to the observations made by this Court, learned Special Government Pleader would submit that the encroachments have already been removed. However, learned counsel for the petitioner objected the same by stating that some of the encroachments are yet to be removed.

4. However, this Court finds that there is no direction to remove the demarcated encroachments in a particular manner. In the absence of any

specific direction, it would be difficult for the Court to hold that authorities have committed contempt of Court willfully. Since the element of disobedience is invisible, this Court is of the opinion that no further proceedings need to be continued in the present contempt petition. However, if any grievance exists to the petitioner, he is at liberty to submit an appropriate application in the manner known to law.
