ORDER

Seeking a direction to the respondent police to register an FIR on the petitioner's complaint dated 02.05.2015 pending on the file of the respondent as CSR No.655/2015 and investigate the same, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. On reading of the complaint, it is seen that the petitioner had lent Rs.4 Lakhs on 21.2.2013 and another Rs.2 Lakhs on 29.3.2015 to the opposite party and the said opposite party has not returned the amounts. That apart, even according to the complaint, the opposite party has given a letter dated 29.3.2015, in which he has agreed to return Rs.2 Lakhs. Hence, the dispute is essentially civil in nature and no positive direction as sought for by the petitioner can be granted.

4. Hence, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedies in the manner known to law.
