PRAYER: Transfer Civil Miscellaneous Petition is filed under Section 24 of Civil Procedure Code, to withdraw and transfer the case pending on the file of the Family Court, Karailkal in M.C.No.1 of 2022 to Family Court at Kallakurichi. For Petitioner :

O R D E R

The husband has sought to transfer the maintenance case filed by the wife on the file of the Family Court, Karaikal to the file of the Family Court at Kallakurichi. 2.

The wife has filed an application for maintenance in M.C.No.1 of 2022, which means that the husband has not taken steps to maintain his wife or his two children. While so, if the matter is transferred to Family Court at Kallakurichi, the wife has to travel for every hearing.

Considering the fact the husband has not taken steps to maintain his wife and his children, this Tr.C.M.P is dismissed. No costs. Consequently, connected miscellaneous petition is closed. However, the presence of the petitioner-husband for non-effective hearings is dispensed with and he shall be present before the Family Court at Karaikal only for counselling and for adducing evidence.
