This Contempt Petition has been filed seeking initiation of contempt proceedings against the respondent for his willful disobedience of the order passed by this Court in W.P.Crl.No.1745 of 2026 dated 06.01.2026. 1/7

The brief facts of the case are as follows:- 2.1.

The petitioner had filed a criminal writ petition in W.P.Crl.No.1745 of 2025 seeking a direction to the respondent herein, the Director General of Police, State of Tamil Nadu, to take necessary action to dispose of his representation dated 05.07.2025, based on the communication dated 27.07.2025 from the Home Secretary, Government of Tamil Nadu, Fort St. George, in Letter No.e-4116/Police-VIII/2025-1. 2.2.

This Court, vide order dated 06.01.2026, directed the respondent herein to dispose of the petitioner's representation dated 05.07.2025 in accordance with law, taking into consideration the orders dated 06.02.2025 and 16.04.2025 passed by this Court in W.P.No.1532 of 2023 and W.A.No.1179 of 2025 respectively, within a period of four weeks from the date of receipt of a copy of that order. 2.3.

Since the order of this Court dated 06.01.2026 in W.P.Crl.No.1745 of 2025 has not been complied with, the present Contempt Petition has been filed.

The submissions of Mr.M.Mohammed Riyaz, learned counsel representing the Government of Tamil Nadu, for respondent, are as follows:- 2/7

Based on a complaint given by one Selvam @ Selvaraj alleging that the windshield of his vehicle (a TATA 407 bearing registration No.TN 03 A 1139) was damaged due to stone pelting on 19.09.2009, a case in Crime No.528 of 2009 was registered against the petitioner for offences under Sections 336, 427, 294(b) and 506(ii) of IPC and Section 3 of the Tamil Nadu Public Property (Prevention of Damage and Loss) Act. 3.2.

During the course of investigation, the petitioner was arrested and subsequently produced before the Metropolitan Magistrate Court, George Town, for judicial remand, in strict compliance with the guidelines laid down by the Hon'ble Supreme Court. 3.3.

On completion of the investigation, a final report was filed and the same was taken on file as C.C.No.1833 of 2010 by the Chief Metropolitan Magistrate Court, Egmore.

Subsequently, this Court, vide order dated 13.12.2019 passed in Crl.O.P.No.5452 of 2011, quashed the aforesaid criminal proceedings against the petitioner.

Thereafter, the petitioner preferred W.P.No.1532 of 2023 seeking action against the then Inspector of Police, T.Savarinathan for malicious prosecution and also to award compensation of Rs.50,00,000/- for 3/7

the humiliation caused to him. Finding no merit in the petition, this Court dismissed the same vide order dated 06.02.2025. 3.6.

Challenging the same, the petitioner preferred a writ appeal in W.A.No.1179 of 2025. An Hon'ble Division Bench of this Court, vide order dated 16.04.2025, affirmed the order passed by the Hon'ble Single Judge in W.P.No.1532 of 2023 and dismissed the appeal. 3.7.

Subsequently, the petitioner addressed a representation dated 05.07.2025 to the respondent seeking action against the said T.Savarinathan for prosecuting him maliciously. 3.8.

Since the petitioner's representation did not evoke any response, he moved a criminal writ petition in W.P.Crl.No.1745 of 2025, seeking a direction to the Director General of Police, State of Tamil Nadu, to dispose of his representation dated 05.07.2025. 3.9.

In compliance with the order of this Court dated 06.01.2026 passed therein, the Deputy Commissioner of Police, Washermenpet, conducted an enquiry in C.No.181/DC WPT/ Crime/2026. Concluding that the initial representation of the petitioner dated 05.07.2025 and the subsequent representation dated 11.11.2025 for initiating disciplinary action against the police personnel were devoid of merit, the Deputy Commissioner of Police disposed of those representations, holding 4/7

that no further action was required. Further, a communication to that effect has also been sent to the petitioner.

3.10. Thus, the order of this Court dated 06.01.2026 has been complied with in letter and spirit. Consequently, the respondent may be pardoned and absolved of the charge of contempt. 4.

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record, this Court finds that in compliance with the directions issued by this Court on 06.01.2026 in W.P.Crl.No.1745 of 2025, a due enquiry has been conducted and concluded by the Deputy Commissioner of Police, Washermenpet and thus, the order of this Court dated 06.01.2026 alleging non-compliance of which, this Contempt Petition has been filed, has been complied with. 5.

Accordingly, this Contempt Petition stands closed. 01.06.2026 ham 5/7
