ORDER
This Revision Petition has been filed to set aside the daily order dated 04.03.2026 on the file of Learned District Munsif Cum Judicial Magistrate, Sholinganallur in IA.No. 3 of 2025 in OS.No.145 of 2025 to withdraw the suit in OS No.145 of 2025 on the file of Learned District Munsif cum Judicial Magistrate, Sholinganallur to the file of this Hon'ble Court and consequently pass a Decree in terms of Memorandum of Compromise dated 15.12.2025.
2. The learned counsel for the petitioners and the respondent would jointly submit that the petitioner herein has filed the suit in O.S. No.145 of 2025 on the file of the District Munsif Cum Judicial Magistrate, Sholinganallur against the defendant/respondent herein. During the pendency of the suit, the matter has been settled between the parties and accordingly a Joint memo Compromise has been entered into between the parties. Further he would submit that though the application under Order XXIII Rule 3, CPC was filed on the date of compromise, the learned District Munsif cum Judicial Magistrate has not recorded the Joint Memo Compromise and passed the Decree in terms of the Joint Memo Compromise and simply adjourned the matter without recording
the Joint Memo Compromise. Hence, this Civil Revision Petition has been filed.
3. Having considered the facts and circumstances of the case and submissions made by the learned counsel for both parties, it is seen that both parties have settled the matter amicably and entered into a Joint memo compromise dated 15.12.2025. Hence, the Trial Court is hereby directed to record the Joint Memo Compromise entered into between the parties and pass the decree in terms of the Compromise Memo in accordance with law within a period of two weeks from the date of receipt of copy of this order.
4. In view of the aforesaid directions, this Revision Petition is disposed of. No Costs.
