Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Declaration to declare the land acquisition proceedings initiated by the respondents under the National Highways Act 1956 as amended for the purpose of building (widening / four laning etc) for Bangalore-Chennai Expressway as null and void pertaining to the petitioner's agricultural lands in new Survey No.63/1B measuring an extent of 2370 sq.mts, new Survey No. 63/3B measuring an extent of 3280 sq.mts and new Survey No. 73/4B measuring an extent of 1260 sq.mts in all measuring 6910 sq.mts at Keeranallur Village, Sriperumbudur Taluk, Kanchipuram District.

ORDER

This Writ Petition has been filed seeking a declaration that the land acquisition proceedings initiated by the respondents under the National Highways Act, 1956 as null and void.

2. Heard the learned counsel appearing on either side and

perused the materials available on record.

3. The petitioner owned properties comprised in Survery No.63/1, measuring an extent of 0.24.00 Hectare, Survey No.63/3, measuring an extent of 0.47.00 Hectare, Survey No.73, measuring an extent of 0.25.50 Hectare and Survey No.74/4 measuring an extent of 0.27.50 Hectare, in total measuring 1.24.00 Hectare, situated at Keeranallur Village, Sriperumbudur Taluk, Kanchipuram District. Thereafter, the said lands were acquired by the respondents for the purpose of widening the Bangalore to Chennai Expressway (four-lane project).

4. After following all the procedure, compensation was paid to the petitioner to the tune of Rs.84,81,090/-. However, the petitioner has now sought for re-determination of compensation under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Amendment) Ordinance, 2015. After having been received the entire compensation without raising any objection, now the petitioner cannot be sought for compensation under the said enactment. Even during the award enquiry, the petitioner did not

raise any objections.

5. In view of the above, this Court finds no merit in this writ petition and the same is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. Consequently, connected miscellaneous petition is closed.
