Ms.M.E.Raniselvam, learned Additional Government Pleader takes notice for the respondents.

2. The husband of the petitioner was an Ex-Serviceman. After serving Indian Army, he joined as a Driver in the Public Works Department. The husband of the petitioner died on 06.11.1977. The petitioner is not paid Family Pension by the Tamil Nadu Government on the ground that she is getting Family Pension for the service rendered by her husband in the Army.

3. According to the petitioner, she is entitled to receive family pension for the service rendered by her husband in the Public Works Department. She relied on Circular No.504, dated 17.01.2013 of the Office of the PR.Controller of Defence Accounts (Pensions) in this regard. Hence, she made a representation, dated 03.06.2015 to the first respondent to consider her request for Family Pension. Acknowledgment for the same is enclosed at Page 12 of the typed set of papers. Since no order is passed, the petitioner has come up with this writ petition. https://hcservices.ecourts.gov.in/hcservices/

4. In view of the limited prayer made, the writ petition is disposed of by directing the first respondent to consider the representation of the petitioner dated 03.06.2015 and pass appropriate orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order.
