Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent to entertain my application under domicile category for management quota for admission of MBBS in any of the private self financed medical colleges at Puducherry. O R D E R

The petitioner seeks for a Mandamus directing the first respondent to entertain his application as a domicile of Puduchery under management quota for admission to MBBS Course in any of the private self financing medical colleges at Puducherry.

2. It is claimed by the petitioner that he was born at Puducherry and permanently residing at Puducherry as on date from the date of his birth. It is further stated that though he completed his +2 Course at Chennai, his parents are still at Puducherry. Therefore, the petitioner claimed that he should be considered for admission to MBBS Course as he is the domicile of Puducherry. It is stated that when his application was not considered, the petitioner made a request on 26.08.2017 in writing to consider him for admission to the MBBS course in any of the Private Self Financing Colleges. As the said request was not considered so far, the petitioner has come before this Court and filed the present Writ petition.

3. Learned Government Pleader, Government of Puducherry, produced a letter written to him dated 29.08.2017 by the Co-ordinator (Admission) CENTAC, stating that either the candidate or his parents should have produced the residence/nativity certificate to prove their continuance residence of five

years preceding the application. Learned Government Pleader (Puducherry) further submitted that as the petitioner's father is having the nativity certificate dated 28.08.2017 indicating that he is the native of Union Territory of Puducherry, by virtue of his birth/continuance residence for five years, the petitioner's case will be considered based on such Certificate.

Upon considering the case of the petitioner and on perusing the nativity certificate issued to the petitioner's father as well as the letter addressed by the Coordinator (Admission) CENTAC dated 29.08.2017 to the Government Pleader (Puducherry) as stated supra, I do not think that the petitioner can have any further grievance as it is for the first respondent to consider his claim, based on the nativity certificate issued to the petitioner's father dated 29.08.2017. Accordingly, this writ petition is disposed of, by directing the first respondent to consider the claim of the petitioner, based on the nativity certificate issued to his father as stated supra.
