Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the 3rd respondent to execute the Non-Bailable Warrant in STC.No.128 of 2024 on the file of Fast Tract Court - Judicial Magistrate, Thiruthuraipoondi, Thiruvarur District within the stipulated time.

O R D E R

This Criminal Original Petition has been filed seeking a direction to the third respondent to execute the Non-Bailable warrant issued against the first respondent in STC No.128 of 2024 on the file of the Judicial Magistrate, Fast Track Court, Thiruthuraipoondi, Thiruvarur District.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents 2 and 3. Perused the materials available on record.

3. The petitioner is the complainant in STC No.128 of 2024 on the file of the Judicial Magistrate, Fast Track Court, Thiruthuraipoondi, Thiruvarur District, filed against the first respondent for the offence punishable under Section 138 of the Negotiable Instruments Act. After receipt of the summons from the Trial Court, the first respondent failed to appear before the Trial Court and as such the Trial Court issued a Non-Bailable Warrant against the first respondent.

4. In view of the above, the third respondent is directed to execute the Non-Bailable Warrant issued against the first respondent,

within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish the correct address of the first respondent and to extend full cooperation during the execution of the Non-Bailable Warrant.

5. With the above direction, this Criminal Original Petition stands disposed of.
